Meeting between the Directorate of Health and the Medical Association about the process behind the recommendation on tools for the determination of term

Background
In 2013, the Directorate of Health received an assignment from the Ministry of Health and Care Services (HOD) to assess what is currently the most accurate and research-based tool for calculating the duration of pregnancy and how the authorities can ensure that this tool is used in all professional environments.
In October 2014, the Directorate of Health presented its recommendation on the use of eSnurra as the most accurate and scientifically proven best tool. HOD asked in a letter of 23.10.2014 for the Directorate of Health to take the necessary measures to implement the recommendation, including ensuring adequate information for the services. The RHFs were subsequently informed and have informed their HF about the recommendation.
The medical association of the Norwegian Gynecological Association (NGF) has, following the recommendation, expressed disagreement with the Directorate of Health.
The Medical Association had asked for the meeting to discuss the process in this case, the situation now and further cooperation with the Directorate of Health.

Cooperation ahead
The Directorate of Health emphasized the traditionally close and good collaboration with the Medical Association and emphasized that the Directorate of Health continues to wish good cooperation.
The Medical Association wishes that the Directorate of Health in the future will, to a greater extent, invite representatives of the professional associations into similar processes.
The Directorate of Health will in the future invite representatives from the regional health authorities and from the Medical Association to the professional associations in professional processes when appropriate.
The parties agreed to work for good cooperation and involve each other.

Background

Process and situation now
Medical Association:
- The Medical Association believes there has been insufficient relevant professional medical involvement in this process by the Directorate of Health since neither the Norwegian Gynecological Association nor the authors of NGF's counselor in childbirth has been contacted in the final decision-making process.
- The medical association believes that the involvement of specialist medical associations is important and that there is generally a greater possibility of achieving results if the Medical Association is involved in academic processes.
- Medical Association encourages the Norwegian Directorate of Health to invite professional medical associations into processes
- The Directorate of Health was invited and participated at the start of NGF's latest audits of both the Guidance in Childbirth and Guidance in Gynecology and has provided positive feedback for this inclusion,
- There is no consensus between the Directorate of Health and the Medical Association about the choice of tools, but the Medical Association does not want a return fight as it is the process that is more important than the result now.
- The Medical Association shows that NGF's supervisor is developed after extensive academic knowledge-based work and is important for the involvement and follow-up of the professional communities.
- The Medical Association does not believe that the recommendation for using eSnurra will be followed by those who now use the Terminhjulet .
Directorate of Health:
- The Directorate of Health believes that their recommendation is based on scientific documentation of what is the best tool.
- The Norwegian Directorate of Health believes it is important to use a tool nationally. This is particularly important given the provisions of the abortion legislation to ensure equality of the law. It is particularly important when applying for abortion around the transit line. The Terminhjulet and eSnurra can give up to 4 days difference
- The Directorate of Health's conclusion is based on several years of dialogue with parts of the academic communities, as well as the Knowledge Center's assessment and experts.
- The Norwegian Directorate of Health has been in meetings and wanted dialogue with the Medical Association / NGF on the choice of tools, and had perceived that NGF did not want this, nor in the work of NGF's supervisor. The invitation to start-up meeting on the review of the supervisor was not followed up further from the NGF, despite initiatives for cooperation from the Directorate of Health.
- Based on the opinion of the Directorate of Health, there was no agreement on the content of the relevant supervisory chapter among the participants in the work of NGF's supervisor.
- The Directorate of Health will not change its recommendation for using eSnurra.
- If there is a supervisory case, it is up to the Norwegian Board of Health Supervision to decide whether it is appropriate to use the Terminhjulet. This is especially true of the question of abortion applicants' rights.
Cooperation ahead

Helsedirektoratet la i oktober 2014 fram sin anbefaling om bruk av eSnurra som det mest presise og vitenskapelig dokumentert beste verktøyet. HOD ba i brev 23.10.2014 Helsedirektoratet iverksette nødvendige tiltak for å gjennomføre anbefalingen, blant annet sikre tilstrekkelig informasjon til tjenestene. RHFene er seinere informert og har informert sine HF om anbefalingen.
Legeforeningen ved Norsk Gynekologisk forening (NGF) har etter at anbefalingen kom, uttrykt uenighet med Helsedirektoratet.
Legeforeningen hadde bedt om møtet for å diskutere prosessen i denne saken, situasjonen nå og videre samarbeid med Helsedirektoratet.

Prosess og situasjonen nå
Legeforeningen:
- Legeforeningen mener det har vært mangelfull relevant fagmedisinsk involvering i denne prosessen fra Helsedirektoratets side, da hverken Norsk Gynekologisk Forening eller forfatterne av NGFs veileder i fødselshjelp har vært kontaktet i den endelige beslutningsprosessen.
- Legeforeningen mener involvering av fagmedisinske foreninger er viktig og at det generelt er større mulighet for å oppnå resultater hvis Legeforeningen involveres i faglige prosesser.
- Legeforeningen oppfordrer Helsedirektoratet til å invitere fagmedisinske foreninger inn i prosesser
- Helsedirektoratet var invitert og deltok ved oppstart av NGFs siste revisjoner av både Veileder i Fødselshjelp og Veileder i gynekologi, og har fremkommet med positive tilbakemeldinger for denne inkluderingen,
- Det er ikke enighet mellom Helsedirektoratet og Legeforeningen om valg av verktøy. men Legeforeningen ønsker ikke omkamp da det er prosessen mer enn resultat som er viktigst nå.
- Legeforeningen viser til at NGFs veileder er utviklet etter et omfattende faglig kunnskapsbasert arbeid og er viktig for involvering av og oppfølging ved fagmiljøene.
- Legeforeningen tror ikke anbefalingen om bruk av eSnurra vil bli fulgt av dem som nå bruker Terminhjulet.
Helsedirektoratet:
- Helsedirektoratet mener at deres anbefaling bygger på vitenskapelig dokumentasjon av hva som er det beste verktøyet.
- Helsedirektoratet mener det er viktig med bruk av ett verktøy nasjonalt. Dette er spesielt viktig med tanke på abortlovgivningens bestemmelser for å sikre likhet for loven. Det er spesielt viktig ved søknad om abort rundt seinabortgrensen. Terminhjulet og eSnurra kan gi opp til 4 dagers forskjell
- Helsedirektoratets konklusjon er basert på flere års dialog med deler av fagmiljøene, samt Kunnskapssenterets vurdering og eksperter.
- Helsedirektoratet har vært i møter og ønsket dialog med Legeforeningen/NGF om valg av verktøy, og hadde oppfattet at NGF ikke ønsket dette, heller ikke i arbeidet med NGFs veileder. Invitasjonen til oppstartmøte om revisjon av veilederen, ble ikke fulgt opp videre fra NGF, til tross for initiativ til samarbeid fra Helsedirektoratet.
- Ut fra det Helsedirektoratet oppfatning, var det ikke enighet om innholdet i det aktuelle veilederkapitel blant deltakerne i arbeidet med NGFs veileder.
- Helsedirektoratet kommer ikke til å endre sin anbefaling om bruk av eSnurra.
- Hvis det kommer en tilsynssak, er det opp til Helsetilsynet å ta stilling til om det er forsvarlig å bruke Terminhjulet. Dette gjelder spesielt spørsmålet om abortsøkendes rettigheter.
Samarbeid framover
- Helsedirektoratet framhevet det tradisjonelt tette og gode samarbeidet med Legeforeningen og understreket at Helsedirektoratet fortsatt ønsker et godt samarbeid.
- Legeforeningen ønsker at Helsedirektoratet i framtiden i større grad skal invitere representanter for de fagmedisinske foreningene inn i tilsvarende prosesser.
- Helsedirektoratet vil i framtiden invitere representanter både for de regionale helseforetakene og for Legeforeningen ved de fagmedisinske foreningene i faglige prosesser når det er aktuelt.
- Partene var enige om å arbeide for godt samarbeid og involvere hverandre.
